These Terms of Service ("Terms") govern your use of PhotoBanao (photobanao.in), operated by Chanakya Takle, Nashik, India ("we", "us", "our"). By using our service, you agree to these Terms.

1. What We Do

PhotoBanao is an AI-powered photo transformation service. You upload a selfie, and our AI generates professional-style photos in various styles (corporate, business casual, startup, matrimonial, traditional). The output images are AI-generated representations — they are not traditional photographs.

2. Eligibility

You must be at least 18 years old to use this service. By uploading a photo, you confirm you are 18 or older. If you are uploading on behalf of someone else, you confirm you have their explicit consent to do so.

3. Your Photos — Upload Rules

By uploading a photo, you confirm that:

• The photo is of you, or you have explicit consent from the person in the photo.
• You will not upload photos of minors (anyone under 18).
• You will not upload photos of anyone without their knowledge or permission.
• The photo does not contain nudity, violence, or illegal content.

We reserve the right to refuse service if any uploaded content violates these rules.

4. AI-Generated Output — What You Get

• The photos generated by our AI are digital creations based on your uploaded selfie.
• Output quality depends on the quality of your uploaded photo. We do our best, but results may vary.
• AI-generated photos may not be perfectly accurate representations. Minor variations in facial features, skin tone, lighting, and proportions are normal and expected.
• We do not guarantee that generated photos will be accepted by any specific platform, employer, institution, or government authority. Acceptance is ultimately at the discretion of the receiving party.
• You receive a non-exclusive, perpetual, worldwide license to use the generated photos for personal and professional purposes (profiles, resumes, social media, applications, etc.).

5. What You Cannot Do

You agree NOT to use the generated photos to:

• Impersonate another person or create fake identities.
• Create deepfakes, misleading content, or content intended to deceive others.
• Generate content that is defamatory, hateful, obscene, or illegal.
• Resell, redistribute, or commercially license the generated photos to third parties.
• Reverse engineer, decompile, or attempt to extract our AI models, algorithms, or source code.

6. Payments

• All prices are listed in Indian Rupees (INR) and include applicable taxes.
• Payments are processed securely through Razorpay. We do not store your payment card details.
• Once payment is confirmed, your photos are generated and made available for download.

7. Photo Storage and Deletion

• Your uploaded selfie and generated photos are stored temporarily to deliver the service.
• All photos (uploads and generated outputs) are automatically deleted from our servers within 24 hours of generation.
• We do not retain, archive, or use your photos after this 24-hour window.
• We do not sell, share, or transfer your photos to any third party.
• You are responsible for downloading your photos within the 24-hour window. After deletion, we cannot recover them.

8. Intellectual Property

• You retain all rights to your uploaded selfie.
• The AI-generated photos are created for your use under the license described in Section 4.
• Our website, branding, AI models, code, and content are our intellectual property and may not be copied, reproduced, or used without written permission.

9. Limitation of Liability

• PhotoBanao is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• Our total liability for any claim related to the service is limited to the amount you paid for the specific transaction in question.
• We are not responsible for how you use the generated photos, including any consequences of submitting AI-generated photos to employers, government authorities, matrimonial platforms, or any other entity.

10. Indemnification

You agree to indemnify and hold harmless PhotoBanao, its owner, operators, and affiliates from any third-party claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from your misuse of the service, your violation of these Terms, or your violation of any third party's rights.

11. Service Availability

• We aim to keep the service available 24/7 but do not guarantee uninterrupted access.
• We may modify, suspend, or discontinue any part of the service at any time without prior notice.
• We are not liable for any loss or inconvenience caused by service downtime.

12. Age Restriction — No Children's Data

• This service is strictly for users aged 18 and above.
• We do not knowingly collect or process photos of minors.
• If we discover that a photo of a minor has been uploaded, we will delete it immediately and terminate the associated account/order.

13. Changes to Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the service after changes constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nashik, India.
